Yanature is a company that offers services of guided-hiking tours in Mauritius. These general terms and conditions of sale are concluded between: – on the one hand, a legal person or entity, called “the client”, who books a service either via the website “trekkingmauritius.com”, or on one of the various third-party online booking platforms such as “TripAdvisor” “GetYourGuide” or any other third-party provider, either by e-mail “email@example.com” or by telephone. – And, on the other hand, Yanature, head office 41 Morcellement Villaze, Black-River Mauritius, 90621. These general terms and conditions of sale are intended to define the terms and conditions for booking and participating in services between Yanature and the customer. They apply to all reservations of services offered on the website www.trekkingmauritius.com, and the mentioned above third-parties providers and any other one, whether the order has been placed by telephone, by post, by e-mail or directly through the website of Yanature (online sale). They also apply when validating quotes. All services must be booked. All reservations on the site www.trekkingmauritius.com necessarily imply that the customer has read these general terms and conditions of sale, prior to the order, and that the customer accepts all their content. The acceptance of these general terms and conditions of sale takes effect upon validation of the reservation of services or acceptance of the quotation by the customer. Consequently, the client acknowledges that he is fully informed of the fact that his agreement concerning the content of these general conditions does not require the handwritten signature of this document, insofar as the client wishes to book online services presented on the nature hiking guide site. The general terms and conditions of sale applicable are those in force on the day the order or quotation is validated by the customer. Yanature reserves the right to modify the general terms and conditions of sale at any time and without notice, the modifications being then applicable to all orders subsequent to this modification.
2/PROCEDURES FOR BOOKING SERVICES
The customer can make his reservation on the Internet via the website www.trekkingmauritius.com. The data provided by the client and recorded by Yanature at the time of booking constitute proof of transactions between Yanature and the client. The validation click after completing the reservation form constitutes confirmation of the customer’s reservation, and constitutes an electronic signature of the same value as a handwritten signature. It shall constitute irrevocable acceptance of the General Terms and Conditions of Sale. -In the case of a reservation by email, mail or telephone, the booking of the service will only be effective after Yanature has received a deposit of at least 30% of the order or the balance of the service. This deposit will only be collected after the service has been provided by the client. An invoice will then be issued if necessary. -In the case of an order placed online by the customer (distance selling), a payment confirmation email will be sent to the customer with the order number. Yanature reserves the right to refuse a reservation or to honour a service in cases where the customer has not paid in full or in part for a previous order, or in the event that a payment dispute remains. The archiving of purchase orders or reservations and invoices is carried out on a reliable and durable medium that can be produced as proof.
3/MODALITIES OF PARTICIPATION IN GUIDED HIKING TOURS
3/1 Preconditions for participation in the hiking tours
The client must find out the level of physical and sporting difficulty of the service he wishes to book. This information is available on the company’s website. In case of doubt, a phone call to Yanature’s office may be appropriate. A minimum of physical fitness is required to participate in the activities. Depending on the services provided, certain prerequisites are necessary. These are defined in the technical data sheets on Yanature’s website. You must not be medically contraindicated to the practice of the chosen activity.
3/2 Insurance and liability
Each guide is insured for Professional Civil Liability for its own activities. On the other hand, we strongly advise each participant to be covered by civil liability insurance and/or individual accident insurance with the insurer of his choice for the practice of mountain sports. Yanature is insured for civil liability for all the activities it offers and cannot be held liable for activities booked with other service providers. The practice of outdoor activities takes place in a specific environment called “at risk”. Each participant is aware, given the specific nature of the proposed activities, that he or she may run certain risks due in particular to the hazards and unpredictability of the mountain environment. He assumes them in full knowledge of the facts and must comply with the rules of caution and follow the advice given by the professionals. In the event of deterioration of the equipment loaned, the participant/customer may be required to pay compensation for wear and tear or a full refund of the equipment.
If the cancellation is due to the customer’s wish: the refund will be done according to the proximity of the date of the tour and the date of the cancellation. If this request is made at the earliest 48 hours before the service, the total amount of the 30% deposit will be collected, if it is made 18 hours before the service, the total amount of the tour price will be invoiced. – If the cancellation is due to Yanature: the service will be fully refunded without any compensation. Several cases may explain a cancellation or modification of the service proposed by Yanature. – Weather or climatic conditions – The technical and physical level or equipment of the participant(s) does not ensure safety during the service – The impossibility for the guide to supervise the service (illness, accident,…)
4/PRICES AND PAYMENTS
The rates are those that the customer finds on the website www.trekkingmauritius.com or those posted on the websites of partners and tour operators on the date of booking. Yanature reserves the right to change these rates during the season. Yanature accepts the following payment methods: credit card (online payment), bank transfer, bank check, cash. Only online payment by one of the following credit cards will be accepted: CB, Visa, Eurocard, Mastercard. The card is debited at the time of confirmation of the reservation of the service. Yanature uses all necessary means to ensure the security and confidentiality of the data transmitted on the www.trekkingmauritius.com.com website (including online payment). To this end, this site uses a remote payment system and encryption of data in SSL (Secure Socket Layer) mode, which never passes unencrypted over the network. In addition, the transaction is carried out via the MIPS – E-payment solutions e-transaction banking platform, which alone has the confidential information (card number, validity date) provided by the customer at the time of payment.
5/FAILURE TO PAY, DISPUTES
The parties shall endeavour to resolve amicably any difficulties that may arise in the performance of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and execution of this Agreement shall be governed exclusively by the rules of the law of the Republic of Mauritius. All disputes, of any nature whatsoever, shall fall within the jurisdiction of the Mauritian civil and commercial courts, including those ruling on summary proceedings. The French and English versions of this document are the only authentic versions.
